Terms & Condition

1. Scope
These terms apply to all forwarding, logistics, and transport-related services provided by First Class Freight (hereinafter referred to as “FCF”), unless explicitly agreed otherwise in writing. By engaging our services, the client confirms agreement with these conditions.

2. Definitions
Client: The party that instructs FCF to perform logistics or forwarding services.
FCF: The freight forwarder and logistics provider offering the services.
Service: Any forwarding, customs handling, warehousing, or transport activity performed by FCF.
Goods: All items entrusted to FCF for shipment, handling, or storage, including related documents.

3. Services & Responsibilities
FCF may act as a forwarding agent or transport operator, depending on the agreement. The client must provide all relevant information, documentation, and instructions in a timely, accurate, and complete manner.
Unless explicitly agreed otherwise, FCF may choose the transport methods and subcontract partners at its discretion. FCF is entitled to consolidate shipments and determine routes in line with industry standards.

4. Customs & Documentation
Clients are responsible for the legality, completeness, and correctness of the documents and declarations they provide. FCF may assist with customs formalities, but shall not be held liable for penalties or delays caused by inaccurate or missing information from the client.

5. Storage & Cargo Handling
In case goods cannot be delivered as instructed, FCF may store them at the client’s cost and risk. Dangerous, perishable, or harmful goods may be disposed of or sold if no safe handling can be ensured, upon prior notice.

6. Liability
FCF is only liable for direct material loss resulting from proven fault, and never for indirect or consequential damages. The liability is limited to €5 per damaged or missing kg of gross weight, with a maximum of €25,000 per assignment.

FCF is not liable for damages due to force majeure, theft, third-party failure, or customs authority actions, unless due to gross negligence on FCF’s part.

7. Payments
All invoices are payable within 8 days of the invoice date. Late payments incur statutory interest plus 10% fixed administrative damages. Currency fluctuations and additional costs imposed by third parties are borne by the client.

8. Right of Retention
FCF holds a legal right of retention and pledge on goods and related documents in its possession until all outstanding claims have been settled in full.

9. Insurance
Goods are not insured unless the client specifically requests and agrees to the cost of insurance in writing.

10. Claims & Disputes
Any claim must be submitted in writing within 14 days of delivery. Legal claims expire after 6 months unless brought before the competent court.

All disputes fall under the exclusive jurisdiction of the courts in the region of FCF’s registered office. Belgian law exclusively applies.
